A Porsche driver who was spotted by cops drinking beer in his car at a petrol station has been banned from the road.

Sam Scudder, 39, from Swanley was seen by a police officer drinking from a bottle of beer at the wheel of his Cayenne Turbo, so he was asked to take a breath test.

Scudder, of Court Crescent, gave a reading of 44 microgrammes of alcohol in 100 millilitres of breath, the legal limit is 35.

He was arrested and charged with being in charge of a vehicle while over the legal limit and admitted the offence when he appeared before magistrates in Medway on November 16.

Debbie Jones prosecuting said: "The officer spotted the vehicle and the engine was running and there was a female in the car.

"The man in the driver's seat was drinking a bottle of beer so he approached him and asked him to take a breath test which was positive.

"He's of previous good character and made admissions during interview."

The court heard Scudder had pulled over into the petrol station in Princes Road, Dartford, on October 11 because he had a flat tyre after hitting a kerb.

He said he had purchased the beer in the garage and was drinking it because his car was not going anywhere.

Magistrates were told Scudder, who takes home £2,000 a month and is the director of his own air conditioning company, had earlier been out for a meal with his partner.

As they were driving back, she told him she was pregnant. Scudder said he had swerved as he was driving because he was shocked. He hit the kerb, damaging his tyre.

The bench was also told Scudder, who is now separated from his partner, already has three points on his licence.

As a result they decided to punish him by endorsing his licence with a further 10 points, which made him a "totter" - when a driver incurs 12 or more penalty points within a three-year period so a minimum period of disqualification must be imposed. They banned him from driving for six months.

Scudder was also fined £153 and ordered to pay a victim surcharge of £61 and £85 court costs.
