A drink-driving McDonald's customer high on cannabis was shopped by staff after he pulled up and ordered while sweating and incoherent.

Workers at the drive-thru on the Park Farm retail park in Folkestone suspected Charlie Miller was under the influence so alerted police officers eating in a nearby patrol car.

The 24-year-old admitted he had been drinking and smoking cannabis, and failed roadside tests for both.

Miller, of Ivy Way, Folkestone, was later charged with drink-driving after giving a reading of 42 micrograms of alcohol in 100ml of breath - the legal limit is 35.

But he escaped a drug-driving charge as the cannabis levels on a further test at the police station were found to be legal.

Miller appeared in the dock at Folkestone Magistrates' Court on Wednesday and admitting drink-driving on November 6.

He wrote a letter to District Judge Justin Barron asking not to banned from the road as his parents had told him he would have to find somewhere else to live if he was disqualified.

When the judge asked more questions about this, Miller said: “My parents said I would have to leave home if I got disqualified.

“My parents were not happy and they are very strict. It’s my fault. I will have to deal with it.”

Judge Barron fined Miller £120 and banned him from driving for the obligatory minimum period of one year.

He said: “I have no choice [but to ban you].

"It’s not sensible to be thrown out. It was a low reading and you were high on cannabis, but have no previous convictions.

"I hope you can persuade your parents - tell them the judge had to disqualify you.”
