A provisional driver found asleep at the wheel while over the legal limit had drunk four beers after a row with his mum about wearing his dirty work boots in her home.

Nico Adams was spotted by a member of the public in a Landrover Freelander just after 6.30am on August 13.

When officers arrived they saw the 29-year-old in the vehicle in a parking bay in Lobelia Close, Gillingham, and knocked on the window to rouse him.

When the door was opened, officers smelt alcohol on his breath.

Inquiries found Adams, who lives in the same road, was also uninsured for the vehicle and only had a provisional licence.

He was arrested and taken to the police station where he gave a breath test reading of 72 micrograms of alcohol per 100 millilitres of breath – the legal limit is 35.

The father-of-two was charged with being in charge of a vehicle while over the legal limit. He was also charged with having no licence and using a vehicle without insurance.

He appeared before magistrates in Medway on September 14 and admitted all three offences.

Debbie Jones, prosecuting, said: "He is also on a suspended sentence."

However, it was not revealed why he had been given this.

The court also heard he had an argument with his mother after wearing his dirty work boots.

Magistrates were told Adams was making strides in his life and had got a job with a construction firm and that he knew he was stupid to get in the vehicle, but did so to get away from his mother.

He also said a friend had driven the car home that morning.

A probation officer revealed Adams had been doing well with his progress on his suspended sentence and that apart from this offence, was going in the right direction.

As a result magistrates decided not to activate the suspended sentence.

Instead they banned him from driving for two weeks and fined him £300 for the being in charge of a vehicle while over the legal limit offence. two week ban correct

He was also fined £300 for the no-insurance offence and he received no separate penalty for the no-licence offence.

Adams was also placed on a six-month community order which will see him complete five rehabilitation activity requirement sessions.

He must wear an alcohol abstinence tag for 60 days and pay a £114 victim surcharge and £85 costs.
